Stiffer Penalties for Child Sexual Abusers

This bill proposes significant changes to sentencing guidelines for lewd conduct with a child:

• Death Penalty Potential:
  • The bill introduces the possibility of the death penalty for aggravated lewd conduct with a child under 12, with the decision left to county prosecutors.
  • "Aggravated lewd conduct" is a new charge defined by 17 aggravating factors, including kidnapping and human trafficking.il
  • If two aggravating factors are proven, and the death penalty is not pursued, a life sentence with a minimum of 30 years is mandated.
• Mandatory Minimum Sentences:
  • A new mandatory minimum of 25 years is established for lewd conduct with a child aged 13 to 15.
  • Aggravated lewd conduct will carry a minimum of up to 30 years in prison.
